South West tree giveaway: terms and conditions
These terms and conditions are subject to any other terms and conditions provided to you or to which you are referred at the time of submitting your details.
By making an application for a complimentary tree pack, you are assumed to have read and consented to these terms and conditions.
Entry requirements
- There is no entry fee and no purchase is necessary to participate in this giveaway.
- The applicant(s) must be aged 18 or over.
- The applicant(s) must be engaged in farming, agriculture or horticulture and be based in the UK in South West region (if you are in any doubt as to whether you meet this criteria or whether your region qualifies, please contact the Woodland Trust prior to submitting your application).
- Only direct applications are allowed – applicants cannot apply on behalf of another third party. Use of a false name or address will result in disqualification.
- To participate in this giveaway, applicant(s) must submit their details on the South West tree giveaway entry form.
- The successful applicants must own suitable land or have access to suitable land with the express permission of the landowner to plant the trees.
Giveaway details
- A total of 2,500 tree packs, each containing 45 trees, are available and will be awarded to the successful applicants on a first-come, first-served basis. Once all available 2,500 tree packs have been successfully allocated to claimants, this event will close.
- Every successful applicant will be able to choose from a selection of tree protection options, subject to availability. All options still available will be selectable on the online application form.
- A maximum of two tree packs per applicant can be claimed.
- Only one application per household can apply.
- There is no cash alternative in part or in whole.
- The tree packs are subject to the supplier’s availability and the Woodland Trust reserves the right to substitute any tree pack or tree protection package with another of equivalent value without giving notice, including altering the mix of species within each tree pack.
- While every effort is made by the Woodland Trust and its supplier of the trees to ensure that the trees are of suitable quality and true to name, no warranty expressed or implied is given as to the description, quality, growth, productiveness or suitability of those trees to their ultimate location.
- Tree packs cannot be posted to the successful applicants. Successful applicants will be responsible for collecting, or arranging collection and safe transit of, their allocated tree packs from our designated collection point/s. A list of the collection points is available and selectable on the online application form.
- Successful applicant(s) will receive a reminder by email a few days before their collection event. If applicants fail to collect (or arrange collection of) their trees on the allocated date, those tree packs will be re-allocated to the next successful applicant. Note that the Woodland Trust cannot amend applicants' details, including their tree pack and tree protection options, once the application form has been submitted.
- Any trees provided under the scheme must be used solely for the purpose of planting on the applicant’s own land (or on land which the applicant has the express permission of the landowner to plant the trees) and must not be sold on, distributed or otherwise used for commercial purposes or otherwise disposed of.
- The Woodland Trust accepts no responsibility for any damage to person or property or any other claims arising from the trees received by applicants, including but not limited to, the successful applicant’s planting or use of the trees provided in the tree packs and any claims arising from damage to property or injury caused by the trees due to incorrect or unsuitable handling or planting.
- The Woodland Trust reserves the right to cancel or change the tree giveaway event and these terms and conditions without advance notice. Any changes will be notified as soon as possible by the Woodland Trust.
- If there is any reason to believe that there has been a breach of these terms and conditions, the Woodland Trust may, at its sole discretion, reserve the right to exclude individuals from participating in the scheme.
Data protection
- The Woodland Trust takes privacy very seriously and will only use the applicant’s personal information in accordance with the terms of its privacy policy.
- The Woodland Trust will collect and store the following data extracted from the application form:
- Full name
- Email address
- Phone number
- Description of farm
- Planting postcode
- This personal data will only be used for the following purposes:
- managing the relationship with the applicant
- communicating with the applicant regarding the collection events and packs
- answering applicant queries about the giveaway
- for future contact in connection with how the Woodland Trust might be able to further support and assist the applicant.
- Applicants will be asked to provide the Woodland Trust with a valid email address upon collection of the tree packs to allow for aftercare contact and information. Applicants will also have the option to consent to further marketing communications from the Woodland Trust.
- By submitting an entry into this giveaway, applicants consent to their data, as detailed above, being processed by the Woodland Trust in accordance with, and for the purposes set out in, these terms and conditions.
- The personal data of the applicant will not be transferred to any third party.
- By submitting their entry, the applicant acknowledges and agrees that they have read and accepted the terms of the Woodland Trust’s privacy policy.
General rules
- The promoter is the Woodland Trust whose registered office is at: The Woodland Trust, Kempton Way, Grantham, Lincolnshire, NG31 6LL.
- The Woodland Trust is responsible for the administration of this promotion or the fulfilment of any packs.
- No responsibility will be accepted for entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
- While every effort is made by the Woodland Trust and supplier of the tree packs to ensure they are of the highest quality and true to name, no warranty expressed or implied is given as to the description, quality, growth, productiveness or suitability of those trees to their ultimate location.
- The Woodland Trust reserves the right to cancel or amend the tree giveaway at their discretion, and these terms and conditions, without notice in the event of a force majeure event including, but not limited to: catastrophe, governmental or local pandemic restrictions, war, civil or military disturbance, tree disease, storm or severe weather, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the tree giveaway will be notified to successful applicants as soon as possible by the Woodland Trust.
- The tree giveaway and these terms and conditions will be governed by the law of England and Wales and any disputes will be subject to the exclusive jurisdiction of the courts of England. If any provision of these terms and conditions is held invalid by any law, rule, order or determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provision not held to be invalid.
