General provisions

These apply when you visit or use one of our websites including when you order products, donation packs or virtual gifts from one of our websites.

Changes

We may change these Terms at any time, in which case the amended Terms will be posted on our websites and will apply from the date we post them, with the exception of orders which we have accepted from you before the new Terms were posted. These will continue to be subject to the Terms in force when your order was accepted.

Please check these Terms on each occasion you use our websites. If you continue to use our sites you will be bound by the latest Terms.

Using our websites

You agree to only use our sites in a manner that complies with all applicable laws and regulations and is consistent with these Terms and does not infringe the rights of anyone else, nor restrict or inhibit their use and enjoyment of our sites (including, amongst other things, hacking).

We reserve the right in our sole discretion to deny any user access to any of our websites without prior notice.

Registration

You may access and use most parts of our websites without registering your details with us. Before you can take part in our message boards/discussion forums, or otherwise post comments to our websites you will need to register with us.

To purchase products, apply for donation packs or take part in certain other activities on our websites, you also have the option to register with us.

If you choose to register with us, each registration must be for a single user only. Please ensure that the details you provide are correct and complete, and inform us immediately of any changes to the information that you provided when registering.

You must make sure that you keep your password confidential. Do not share it or let anyone else access your account. Always ensure you log out of your account at the end of your session to avoid anyone else using it.

You should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if your password is being, or is likely to be, used in an unauthorised manner. We may disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms.

Privacy and cookie statement

We use, store and process information about you in accordance with our cookie policy. By using our websites, you consent to our use, storage and processing of your information in accordance with that statement.

Donations

We regret that donations cannot be refunded. Our donation packs and virtual gifts are all forms of donations. Please contact our supporter care team on 0330 333 3300 if you have a query about a donation you have made.

Website content including user-generated content

If you have a complaint about any content on (or sent via) any of our websites please notify us immediately by email at enquiries@woodlandtrust.org.uk. Please note that no action can be taken until we receive a fully completed Report content form.

You must not post or transmit to any of our websites any material:

  • that is knowingly false or misleading, defamatory, illegal, abusive, vulgar, hateful, harassing, liable to incite racial hatred, blasphemous, discriminatory, pornographic, sexually oriented, threatening or invasive of a person's privacy.
  • which you do not own or for which you have not obtained all necessary licences and/or approvals.
  • which is technically harmful (including, among other things, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data).
  • impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with anyone or any entity.

If you post or transmit to any of our websites material of the type prohibited under term 6.1 above (or which otherwise results in a claim or action against us) and we incur any costs, expenses, liability or losses as a result, then you agree to indemnify us for all such costs, expenses, liability and losses.

If you post or transmit any material to any of our websites ('contribution'):

  • you grant us a non-exclusive, perpetual, royalty free, worldwide licence to use, highlight, comment, modify or reproduce your contributions in whole or part, in whatever form, on our websites, social media pages and other communications and publications.
  • by submitting a contribution you waive your moral rights including the right to be identified as the author of the content.
  • you grant us the right to use the name that you submit in connection with that material; and

Party political or any other views and opinions expressed in user contributions to our websites do not represent the views or opinions of the Woodland Trust, which is a non-partisan conservation charity. We encourage open debate. However, comments or opinions expressed in contributions posted by our website users are attributable only to the individual contributors.

Intellectual property rights

You acknowledge that all copyright, trademarks and other intellectual property rights in our websites and all photographs, footage, designs, images, text, software, data and other material in our sites or generated by our sites are owned by us or our licensors. You are permitted to use the sites and this material only as expressly authorised by us.

You are permitted to print and download extracts from our websites for your personal non-commercial use and for private study, provided in each case that:

  • copyright and source indications are also printed and copied.
  • no modifications are made to the materials and they are not used as part of any other publication.

The photographic, text and other graphic images within any products or publications supplied to you are copyright works and none of them may be copied, reproduced, licensed or otherwise exploited.

The Woodland Trust name and logo are trademarks of the Woodland Trust. Other logos and names used on our sites may also be the trademarks of the Woodland Trust or their respective owners. No permission is given by us in respect of the use of any such trademarks, names or logos and such use may constitute an infringement of the holder's rights.

Whilst we encourage our supporters to campaign on the issues referred to on our websites, unless we have specifically authorised you in writing to do so please do not imply that you are taking action on behalf of the Woodland Trust and in particular do not state that the Woodland Trust is taking, or proposes or is considering taking, action against individuals or organisations, for example, a boycott of a company's products.

Any rights not expressly granted in these Terms are reserved.

Advertisers and sponsors

We may from on occasion allow companies to advertise goods and services on our websites. Whilst we will not knowingly run an advert that is untrue, or which relates to goods or services contrary to our objects, the appearance of an advert does not mean that we endorse the advertiser's goods or services.

With the exception of products sold on this website, we are not responsible for the accuracy of any advertising material or for any advertised product or service.

If you breach these Terms and we take no action, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms.

Events beyond our control. We will not be liable to you for any delay in delivering any services or order or for breach of our obligations, if the delay or breach is due to acts of God, civil commotion, riots, malicious damage, floods, drought, fire, epidemic, legislation, failure of ISP or telecommunications provider or any other cause beyond our reasonable control. This does not affect your statutory rights.

Law, courts and language

These Terms, use of our sites and the supply of products and services by us are governed by and to be interpreted in accordance with English and Welsh law. In the event of any dispute arising in relation to these Terms, use of our sites or in relation to the supply of any products or services by us the appropriate UK courts will have jurisdiction over the dispute.

These Terms are provided in the English language only.

Provisions that apply when ordering products from our websites

Donation packs are donations to the Woodland Trust which you can apply for through our shop and in return you will receive a certificate and various other benefits as a thank you for your donation. Current donation packs include:

  • membership packs
  • dedicate a tree packs
  • plant a tree packs
  • Nature Detectives memberships
  • memorial certificates
  • virtual gifts
  • woodland carbon.

Availability

All orders for products are subject to availability and we reserve the right to refuse to supply to any individual or company.

Order submission

Your submission of an order represents an offer to purchase the products (or an application for the donation pack) indicated by you and is not binding on us until we have accepted your order. This means that if a product is shown on our sites but is not available or is incorrectly priced or otherwise incorrectly described or if we are unable to arrange delivery to your address or wish to decline your offer/application for any other reason, we will not be obliged to sell you that product/provide you with that donation pack. In this instance we will inform you and not charge for the product/donation pack.

Order acknowledgement

Shortly after we receive your order, we will acknowledge it by email, detailing the products you have ordered/donation pack you have applied for. This email is issued automatically and does not mean that your order is accepted.

Information

We may contact you to obtain further information to enable your order to be evaluated or processed.

Acceptance

Acceptance of your order for a product/application for a donation pack and completion of the contract between you and us will take place when we dispatch the product/donation pack to you.

Any products on the same order which we have not dispatched to you do not form part of that contract.

Alcohol

Alcohol may not be purchased by anyone under 18.

Product price

The price you pay is the price displayed on our site at the time we receive your order apart from where an error has occurred in displaying the price.

While we try and ensure that all prices on our sites are accurate, errors may occur. If we discover an error in the price of products you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it.

If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the products, you will receive a full refund.

VAT

Prices displayed include VAT where applicable. Price and availability information is subject to change without notice.

Products may differ slightly form the images shown. All sizes and dimensions of products as indicated on our sites are approximate but we make every effort to make sure they are as accurate as possible.

We have made every effort to display as accurately as possible the colours of the images that feature on our sites. However, we cannot guarantee your monitor's display will accurately reflect the colour of the product.

Accuracy of details

You are responsible for ensuring the accuracy of the details provided on the order form.

Please take particular care when entering information to be used in or on any products, gifts cards or certificates to be personalised to your requirements.

Order details

We do not file details of your order for you to subsequently access direct on our websites.

Payment for orders and donations

We accept Visa Credit, Visa Debit, Mastercard Credit, Mastercard Debit and Maestro. For orders or one-off donations made online we cannot accept cheques.

For orders from our shop, payment will be taken at the point of goods despatch. For virtual gifts, donation packs and e-cards, payment will be taken at the order processing stage.

By placing an order or making a donation you consent to payment being charged to your debit or credit card as provided on the order form. We will use Secure Trading to validate your payment.

It is possible to set up regular monthly donations by direct debit online. Payment will be set up to be taken from your account on either the 7 or 22 of the month, dependent upon the time of the month your monthly donation was set up. Payment will be collected on the next or nearest collected date. If you wish to change the date set out in your direct debit agreement to the alternative date we offer, we can do this once the first payment has been taken.

If an error has been made in the payment of your direct debit by us or your bank/building society, under your bank's direct debit guarantee scheme you are entitled to a full and immediate refund of the amount paid from your bank or building society. If you receive a refund you are not entitled to, you must pay it back when requested to do so by the Trust.

You can cancel a direct debit at any time by simply contacting your bank or building society. We would be grateful if you could also let us know that you wish to cancel your regular donation.

In case of query, please call 0330 333 3300 (Monday to Friday, 8.30 am to 5.00 pm), quoting your order reference number.

Delivery

We will let you know what you will be charged for postage, delivery and packaging before you submit your order.

Additional delivery charges may apply for overseas deliveries, or bulky or heavy items and you will be notified of any additional delivery charges during the order process and required to provide your confirmation that such charges will be included in your order and charged to your card prior to the goods being dispatched. If confirmation is not received, then the order cannot be processed and will be cancelled.

Express delivery is not available.

Donation packs will be sent by 2nd class post using Royal Mail or National Carriers and there are no delivery charges.

We aim to:

  • dispatch donation packs, including printed donation pack certificates within 10 working days of receipt of your application/donation. If your application/donation is time-sensitive, you may want to check the dispatch date with our support response team by telephoning them on 0330 333 3300 at the time of applying/donating.
  • deliver all other products ordered within 7-10 working days of your order.

Please allow up to 30 days in case we are exceptionally busy. The delivery timescales stated are subject to availability of the products ordered and circumstances beyond our control. We make every effort to deliver products within the above timescales, however delays are occasionally inevitable.

If you do not receive your products/packs within the time quoted above, please contact our support response team on 0330 333 3300 or email them at customerservices@woodlandtrustshop.com. If we fail to deliver your order within 30 days we will notify you of the reason for the delay and you may cancel your order and we will provide you with a refund for the products not delivered. We will have no other liability to you in the event of delay in delivery.

All deliveries will be made to you (or the recipient specified by you) at the address specified by you in your order. With the exception of gift memberships, we regret that we cannot send membership packs to an alternative delivery address, they will be sent to the main billing address only.

We may, at our discretion and expense, deliver parts of your order separately. You will be responsible for the products as soon as they are delivered.

If we cannot deliver the products to you at the address you have specified for any reason (other than when we are at fault), we will notify you and store the products for up to 30 days. At our discretion we may either attempt to redeliver the products to you or issue you with a refund for the price paid less postage and handling charges. Note – no refund will be made for products which have been customised or personalised in accordance with your requirements.

Returns – if you change your mind

For most products you can cancel your order, either before or after we deliver it, by notifying us within 15 days of delivery (or where we deliver your order in instalments, within 15 days of the last item delivered) without giving any reason. You can do so by contacting our supporter care team on 0330 333 3300 (free from a land-line) or by emailing us at customerservices@woodlandtrustshop.com. To meet the cancellation deadline it is sufficient for you to tell us that you wish to cancel before the cancellation period has expired. You then have 15 days to get the products back to us for a refund.

This right to cancel does not apply to:

  • products which have been made to your specification or personalised, for example where a name or a photograph supplied by you has been added to a product.
  • DVDs, CDs or computer software once you have broken the seal.
  • products which are sealed for health or hygiene reasons once you unseal them (e.g. underwear or swimwear once you have removed the hygiene strip).
  • perishable products (e.g. food, flowers, plants or trees).
  • periodicals or magazines.
  • virtual gifts and donation packs.
  • digital content (such as downloads, games, music, videos, e-cards, e-books or audio books). By placing an order for digital content, you agree that the digital content will be provided during the cancellation period referred to above and acknowledge that this means that you will lose your right to cancel your order for that digital content.
  • products once they have been combined with other products so that they are then inseparable.

Until you are sure that you want to keep the products you have ordered, you must carefully handle the products only to the extent that you would handle them if you were looking at the products or carefully trying them on in a shop, in order to establish the nature, characteristics and functioning of the products. You must not otherwise use or wear them. Products must be returned to us in their original packaging, with all tags intact and in good, re-saleable condition and unused.

Hampers, gift baskets, tree packs and other sets or packs which are made up of a number of products may only be cancelled and returned as a whole.

If the right to cancel applies and you want to return your order once you have received it, for either a refund or exchange, fill out the accompanying delivery slip, package the relevant item securely and send them both to us within 15 days of delivery (or 15 days of you notifying us of your wish to cancel your order as above) using the label provided on the delivery note.

For your protection, we recommend that you use a recorded delivery service. Until the products are returned to us, you must not use them and must take reasonable care of them and ensure that they are returned to us in a re-saleable condition.

Information about how to return products for an exchange or refund is included with each shipped order along with your delivery slip. Please note that you will be responsible for the cost of returning products to us unless we deliver the item to you in error or it is faulty.

Refunds

If you cancel (and where already delivered, return) your order in accordance with the above provisions, we will refund to you:

  • the purchase price for the item cancelled/returned.
  • the standard delivery charge for the item cancelled/returned. Note – where you ordered a number of items and only cancel/return some of them, delivery charges will not be refunded except for such part of delivery charges that relate specifically to the items returned. Any extra charges for express delivery will also not be refunded.

When making a refund (other than a refund for a faulty product), we will deduct from the sum to be refunded any reduction in the value of the products returned caused by you using, wearing or handling the products beyond the manner in which you would handle the products if you were looking at them, or trying them on, in a shop.

Any refund issued under these provisions will be made, using the same means of payment as you used for your order, within 14 days of:

  • us receiving the products back. Or
  • (if earlier) you providing evidence that you have returned the products. Or
  • if you cancel before we despatch the products, of you telling us that you want to cancel your order.

You will not incur any fees as a result of the refund but we will not make the refund until we have received the products back or you have supplied evidence of having sent back the products, whichever is earliest.

If for any reason you suspect that your credit card has been used to make an inaccurate or incorrect transaction through this website, please notify your issuing Bank immediately for investigation.

Trees and other perishable products

Please note that we cannot accept returns of trees or other perishable goods unless they are defective.

Please check your tree as soon as you receive it. If you believe that your tree is defective, it may be that your sapling is in a dormant state, which you can check by scraping back a small piece of bark to see if pale new wood lies beneath.

If having checked your tree as described above, you still think that the tree you have received is defective and you would like to return it for a refund or replacement please contact our supporter care team on 0330 333 3300 (free from a land-line) or by emailing us at customerservices@woodlandtrustshop.com within ten (10) days, but no later than thirty (30) days, of receiving your tree.

Returns – faulty products

By law you are entitled to receive products which are as described, fit for purpose and of satisfactory quality and our aim is to make sure that you do.

If you do receive a product which is faulty and would like to request a refund or replacement please contact our customer care team as soon as possible.

You can find out more about your rights as a consumer on the Citizens Advice Bureau website.

For replacement or refund of the product you will need to return it to us. Our customer care team will help you do this by arranging collection in the case of items unsuitable for return by post.

Donation packs

If you order one of our donation packs you are making a donation to fund our work for which we are enormously grateful. You will receive a certificate to commemorate the dedication/donation but any trees/woods dedicated will not be marked with the dedication although you are welcome to visit the wood dedicated (or where the tree is dedicated).

Your donation pack certificate will be printed with the wording you enter in the application form. Please check this carefully before you finalise your application. If you notice an error in the certificate wording please reply to the automated thank you email you receive and tell us what you would like correcting and we will do our best to make the changes before the certificate is produced.

All items featured in the dedications section of our websites are genuinely needed and used by the programmes that the Woodland Trust supports. However, once certain types of dedications reach their maximum capacity, we reserve the right to use your donation to help the Woodland Trust continue with its full range of work. Where possible we will aim to use your donation for a similar purpose to that originally requested by you.

Email certificates are sent as soon as you have submitted your online donation pack application, though due to circumstances beyond our control they may occasionally take several minutes or possibly even hours before they arrive in the recipient's inbox. If you, or your intended recipient, do not receive the certificate, please contact our supporter care team on 0330 333 3300 providing full details of the donation pack applied for. A copy of your application confirmation is always helpful.

Virtual gifts

If you order one of our virtual gifts you are making a donation to fund our work for which we are enormously grateful and obviously you don’t actually buy the item in question.

All items featured in the virtual gifts pages of our websites are genuinely needed and used by the programmes which the Woodland Trust supports. However, realistically, there are only so many types of virtual gifts required and so if you have ordered a virtual gift your donation will not necessarily be used to purchase the item shown but will be used to help the Woodland Trust to continue with its full range of work. You can read more about the range of the Woodland Trust’s work in the Who we are section of our website.

If the choice of card you want is out of stock we reserve the right to send you another card.

E-cards

The Woodland Trust is not responsible for the messages inserted in e-cards sent from our websites. If you receive an e-card through our website services containing inappropriate content please email us at customerservices@woodlandtrustshop.com and we will deal with your complaint as the Woodland Trust thinks appropriate.

If you send an e-card from our websites you agree:

  • to accept full responsibility for the messages you insert in the e-card ('your messages').
  • to keep your messages decent.

And to not include in your messages:

  • any content of the type referred to in term 1.
  • anything that could be considered offensive, threatening, racist, abusive, defamatory, obscene, indecent, unlawful, hateful or otherwise intended to annoy or harass the recipient.
  • anything that could be considered a criminal or civil offence; nor
  • links to other websites.
  • if we receive a complaint about your message we can disclose your registration details to the person making the complaint.

If we receive a complaint about your messages we reserve the right to (among other things):

  • not send future e-cards from your account.
  • deny you access to our websites and services; and
  • where appropriate, refer the matter (and disclose your details) to the police or appropriate authorities.

Please ensure that you provide us with the recipient’s correct email address for delivery of the e-card. You will not be entitled to a refund if the e-card is sent to the incorrect address due to your own error.

Prize raffles

The Promoter is The Woodland Trust, a company limited by guarantee (Company Number: 1982873) and a registered charity (Charity Number England and Wales: No. 294344, Scotland No. SC038885) whose registered office is at Kempton Way, Grantham, Lincolnshire NG31 6LL.

All participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.

Each raffle will have a closing date for returning tickets and a draw date. These dates and the prizes to be awarded will be stipulated in the raffle announcement and printed on the raffle tickets.

Any specific raffle terms and conditions, applicable only to that particular raffle draw, will be available online prior to commencement of the raffle and may be viewed by going to the website printed on the tickets for that draw.

Where an entry to the raffle is made online, the entrant must ensure that they have received notification of their raffle number. Where a cleared payment has been made but no raffle number has been allocated, entrants should contact the Woodland Trust as soon as reasonably practicable and prior to the date of the draw. Failure to do so is likely to result in the entrant not being entered into the draw and the Woodland Trust will accept no responsibility accordingly.

To enter any Woodland Trust raffle, tickets must be purchased at the specified price per ticket.

Payments for raffle tickets cannot be made by credit card.

Woodland Trust supporters receiving a mailing pack, but purchasing raffle tickets online, will be allocated different ticket numbers to those indicated in the mailing pack.

Prizes are subject to availability. In the event of any prize being unavailable, the Woodland Trust reserves the right to offer an alternative prize of equal or greater value at its sole discretion.

Save as otherwise stated above, the competition prizes cannot be modified and are non-transferable.

The competition decision on winner selection is final and no correspondence will be entered into.

First and second prize winners will be notified by telephone (where a telephone number is available) or using such other contact details provided by the entrant either on the raffle ticket stub or online. Where a winner cannot be contacted using reasonable means within one calendar month of the close of entry, that prize will be redrawn at the discretion of the Woodland Trust and reallocated to an alternative winner.

Payment of any cash prizes will be made by cheque by post within 28 days of the draw.

A list of winners will be published on the Woodland Trust website the week following a draw.

Raffle tickets must not be sold to or by persons under the age of 18 years. Any person under 18 years old who has entered a raffle will automatically forfeit any prize.

Unless otherwise specified, raffles are only open to residents of England, Wales and Scotland and no entries from overseas, Northern Ireland, the Channel Islands or the Isle of Man can be accepted.

The Woodland Trust shall not be liable to reimburse any additional costs/fees/charges/interest/transaction fees (including credit card/debit card charges, interest or transaction fees ) the competition entrants or winners may incur in purchasing a raffle ticket or participating in the competition.

Woodland Trust raffles are not open to:

  • Woodland Trust staff or their immediate family
  • organisations – purchasers of raffle tickets must be specified individual persons.

Only one player can be the owner of a raffle ticket for the purpose of these rules. The owner of the ticket will be the name and address of the person applying for the ticket (i.e. the name on the raffle ticket stub or the name given online) regardless of the method of payment used to purchase the ticket, unless specific written instructions are received by the Woodland Trust at the time of purchase to register the ticket in another name.

Raffles are not open to Woodland Trust trustees or staff or their family members.
Woodland Trust raffles are delivered by WoodsValldata, a third party appointed as an 'External Lottery Manager'. Names of entrants will not be passed to any third-party agency (other than WoodsValldata) and will be processed in strict compliance with data protection legislation.

The Woodland Trust reserves the right to use the names and locations of entrants in its publicity and consent to do so is automatically implied by entering the raffle draw or competition. Should you not wish your name to be used in this way, please contact the Woodland Trust via the website or tick the 'opt-out' box on the web entry /entry form.

The Promoter accepts no responsibility for entries not successfully submitted or received due to postal delays or loss. Any money received after the raffle closing date will not be reimbursed and will be allocated to help fund the work of the Woodland Trust. If you would prefer not to have your entry fee allocated in this way, please contact The Woodland Trust and you can be reimbursed or have your entry fee rolled over to the next raffle draw.

All Woodland Trust raffles are licensed and regulated by the Gambling Commission.

Woodland Trust raffles are intended to be a fun way to support us and the vital work we do. The Woodland Trust reserves the right to vary these terms and conditions and to hold void, cancel, suspend or amend a raffle draw where it becomes necessary to do so. This will only be done in wholly exceptional circumstances and due to unforeseen events beyond our control. Any such variations will be posted on the Woodland Trust's website.

The raffle draw will be governed by English law and entrants to the competition submit to the exclusive jurisdiction of the English courts.

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors, or that of their employees. Your statutory rights are not affected.

Competitions

Winners and prizes

A winner will be selected each month from the eligible entries submitted between the opening and closing dates for that month and the winner will have their winning entry exhibited as part of an open-air exhibition at Londonthorpe Woods in September 2024 and will receive the A2 size print of their winning photograph used in the exhibition. There will be 11 winners in total whose entries will be exhibited.

The Judges, comprised of independent partnership volunteers will select one winner and one second place each month from that month’s entries.

General competition rules

The promoter

The promoter is: The Woodland Trust, a charity registered in England (No. 294344) and in Scotland (No. SC038885), whose registered address is at Kempton Way, Grantham, Lincolnshire, NG31 6LL (“the Trust”).

How to enter

      1. The competition will run from 09:00 on the opening date for that month’s competition stated in the list above (the 'Opening Date') to 23:59 on the closing date for that month’s competition stated in the list above (the 'Closing Date') inclusive.
      2. Entries can be submitted by residents of England and Wales who are 18 or over on the relevant Closing Date of the monthly competition they are entering. Each entrant may submit a maximum of five photographs.
      3. To enter the competition, entries must be submitted in JPEG format by email to ReconnectingGrantham@woodlandtrust.org.uk. Entrants must also include a statement (not exceeding 250 words) saying why they love the site they have photographed.
      4. All competition entries must be received by the Trust as set out in point 3 above by no later than 23.59 on the Closing Date. All competition entries received after the Closing Date, or which do not meet the entry requirements stated in condition 3, will not be considered.
      5. The Trust will not accept:
        (a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
        (b) proof of transmission as proof of receipt of entry to the competition.
      6. By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
      7. Unsuccessful entrants will not be contacted and no feedback on any entry will be provided.
      8. Please take your photos responsibly and always follow the Countryside Code.

Eligibility

The competition is open to all residents in England and Wales aged 18 and over on the relevant Closing Date.
In entering the competition you confirm that your application is your own original work and content and does not infringe any rights of third parties, including but not limited to copyright or use or reproduce any third-party trademarks without the necessary permissions and consents.

Submitted photos MUST be taken within Woodland Trust property at Londonthorpe Woods or the neighbouring National Trust site at Bellmount and MUST NOT feature any private property. Any photos not conforming to this term will not be accepted.

Submitted photos MUST NOT include any identifiable people. Any photos containing identifiable people will not be accepted.

In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Trust may require you to provide proof that you are eligible to enter the competition.

By entering, entrants will be deemed to have agreed to be bound by these competition terms and conditions. The Trust reserves the right to exclude any entry from the competition at any time and in its absolute discretion if the Trust has reason to believe that an entrant has breached these rules, acted fraudulently in any way or brings the Trust into disrepute. The Trust reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

Judging process

The entries will be judged by the Judges, comprising independent partnership volunteers who will choose the winner based on how the photograph meets the monthly theme and its creativity and originality.

The decision of the Judges is final and no correspondence or discussion will be entered into.

Each of the winners will be contacted by a member of the Trust within 21 days of judging taking place.

If the winner is unable to be contacted after reasonable attempts have been made, the Promoter reserves the right to either offer the prize to a runner-up, or to re-offer the prize in any future competition.

The Trust will send the full names of the Judges to anyone who writes within one month after the Closing Date of the competition requesting details of the Judges.

The prize

Each winner will have their photograph exhibited as part of an open-air exhibition at Londonthorpe Woods (or a replacement print if the original was damaged during the exhibition) in Ocotober 2024 and will receive an A2 or A3 sized print of their winning photograph used in the exhibition.

The prize is not negotiable or transferable.

Unsuccessful entrants will not be contacted and no feedback on any entry will be provided.

Winners

The Trust must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Trust will publish your first name, city or county where you live and your winning entry on The Woodland Trust’s ‘Reconnecting Grantham’ Facebook group 21 days after each closing date.

Winners will be invited to attend the exhibition in which their photograph is featured.

The participants agree to co-operate with any reasonable requests by the Trust relating to any post-competition publicity, including social media posts promoting Londonthorpe and Bellmount undertaken by the Trust or the National Trust.

If you object to any or all of your first name, age, and city or county where you live being published or made available, or participating in the required publicity, please contact the Trust at ReconnectingGrantham@woodlandtrust.org.uk. In such circumstances, the Trust must still provide the information and winning entry to the Advertising Standards Authority on request.

Claiming the prize

Winners will receive the A2 or A3 print (at the Trust`s discretion and choice) of their winning photograph following the completion of the exhibition in September 2024.

The prize can be collected by arrangement or will be sent to each winner at the address provided at the time of entry by Royal Mail 2nd Class post by 31 October 2024. Should the dispatch of the prize be significantly delayed, the Promoter will use reasonable efforts to notify the winners about such delay.

The Trust does not accept any responsibility if you are not able to take up the prize.

Limitation of liability

Insofar as is permitted by law, the Trust, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize, except where it is caused by the negligence of the Trust, its agents or distributors, or that of their employees. Your statutory rights are not affected.

Ownership of competition entries and intellectual property rights

Entrants will retain copyright in the photographs they submit to the Trust. By entering the competition all entrants grant to the Trust the right to publish and exhibit their photographs, including on the Trust website and social media, in perpetuity, and the right to edit the photographs for this purpose. Entrants waive any moral rights that they have in the photographs.

Winners whose photographs appear in the exhibition pursuant to 'The prize' section above, grant the Trust (including the Trust’s subsidiaries and other publishers, such as Reconnecting Grantham project partners and funders authorised by the Trust) a non-exclusive, worldwide irrevocable licence to publish and exhibit their photographs in print, on their respective websites or in any other media in perpetuity for the full period of any intellectual property rights in the competition entry and the right to sub-licence the competition entry. Where the entrant is a Trust staff member, this licence shall continue even if the Staff Member is no longer employed by the Woodland Trust.

No fees will be payable for any of the above uses. While the Trust make every effort to credit photographers, including in printed reproductions of their work, it cannot guarantee that every use of the photographs will include the photographers' names.

Data protection and publicity

By submitting a photo, the entrant impliedly consents to The Woodland Trust and its partners and subsidiaries (see section on intellectual property rights above) collecting and storing the names and contact details of all entrants submitting a photo. The Trust will use this personal data for the following purposes only:
a. Communicating with the winning entrant regarding their submission.
b. Exhibiting the winning photograph; and
c. Publishing the submitted image in a Woodland Trust publication.


The Woodland Trust takes privacy very seriously, and will only use personal information in accordance with the terms of its Privacy Policy.

By submitting their photo, the entrant acknowledges and agrees that they have read and accepted the terms of the Woodland Trust’s Privacy Policy and these Terms and Conditions.

General

If there is any reason to believe that there has been a breach of these terms and conditions, the Trust may, at its sole discretion, reserve the right to exclude you from participating in the competition.

The Trust reserves the right to hold void, suspend, cancel or amend the prize competition where it becomes necessary to do so.

These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

      1. The Woodland Trust Volunteer Photography Competition is a competition open to the
        public.
      2. Volunteer entry will be assumed for all registered volunteers for the Woodland Trust who are resident within the UK.
      3. The competition is free to enter and no purchase is necessary.
      4. All under 18s who enter must have parental permission.
      5. To enter the ‘Photography Competition’, all entrants must post on Instagram, including #SmithillsinSpring in their post and tagging the @woodlandtrustsmithillsestate account.
      6. All entry photos must be taken on the Smithills Estate within the competition period.
      7. The opening date for entries is 20 March 2024. The closing date is 31 May 2024. Entries posted after this date will not be accepted.
      8. The promoter accepts no responsibility for entries not successfully submitted online due to
        a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind, or any circumstances outside of reasonable control of the promoter.
      9. The photograph can be black and white or coloured.
      10. The winning photograph in each of the categories will be decided upon by the Smithills Estate team, whose decision will be final and no correspondence will be entered into in relation to their decision.
      11. The Woodland Trust will keep a copy of all submitted photographs, which may be used in Woodland Trust marketing and promotional communications. Photographs that are considered offensive, opposing the nature of the competition or believed to breach copyright will be removed from submissions.
      12. The winner will be notified by Instagram messages within 28 days of the closing date. Each regional winner will be awarded an item from the Woodland Trust shop.
      13. The promoter reserves the right to hold void, cancel, or suspend the competition without notice.
      14. The promoter reserves the right to vary these terms and conditions, and at their discretion will ensure any such variations are notified to the participants either by email or by outlining them on the promoter’s website.
      15. Entrants are deemed to grant the Woodland Trust a perpetual, royalty-free, non-exclusive, world-wide licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, display and exercise all copyright and publicity rights with respect to the entrant’s entry, and/or to incorporate the entrant’s entry in other works, in any media now known or later developed for the full term of any rights that may exist in the
        entrant’s entry.
      16. By entering the competition, the entrants confirm that their entry is their own original work and does not infringe any rights of third parties, including but not limited to copyright, and the entrants consent to the Woodland Trust publishing or using their entries for marketing purposes. If any photograph features other people who are recognisable, the entrant is deemed to have obtained their permission for the submission to be treated according to the
        uses set out above.
      17. The promoter is under no obligation to acknowledge the entrant on any publication of their work. However, the promoter will aim to do so whenever practicable.
      18. The promoter may at its sole discretion publish the name, title, county or region, and country of residence of the winner(s) in the promoter’s communications, including but not limited to the ‘Broadleaf’ magazine, the promoter’s website and social channels. The participants consent to such publication and agree to cooperate with any reasonable requests by the promoter relating to any post-competition publicity.
      19. The promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.

Data protection

The Woodland Trust will collect and store the Instagram account details of all entrants. The Woodland Trust will use this personal data for the following purposes:

      • Managing the relationship between the entrants and the Woodland Trust in this competition
      • Communicating with entrants about all information regarding the competition
      • Communicating with entrants to answer their queries about the competition
      • Communicating with successful entrants and arranging the fulfilment of the prize.

By submitting an entry into this competition, entrants shall be aware their personal data will be processed by the Woodland Trust in accordance with, and for the purposes set out in, these terms and conditions.

The personal data of the winners will not be transferred to any third party other than for the fulfilment of delivery of the prize.

Entry requirements

  • All valid orders received by the Woodland Trust for the “kids’ tree-planting kit” placed between midnight 18 February 2024 and midnight 3 March 2024 will be automatically entered into the prize draw to win a signed copy of the book “The Oak Tree” by Julia Donaldson.
  • Employees, contractors and volunteers working for the Woodland Trust or their family members shall not be permitted to enter the competition.
  • The entrant(s) must be aged 18 or over.
  • The entrant(s) must be UK residents (this excludes Northern Ireland, the Isle of Man and the Channel Islands).
  • Use of a false name or address will result in disqualification.
  • Only one entry per person is permitted per competition, entries on behalf of another person will not be accepted and joint submissions are not permitted.
  • The closing time and date for entry into the kids’ tree-planting kit competition is 23:59 on 3 March 2024, no further entries to the competition will be permitted after the closing time and date

Prizes

  • Five winners will each receive one signed copy of “The Oak Tree” by Julia Donalson worth £12.99.
  • No cash alternative to the prize will be offered.
  • The prize is not transferable.
  • Prizes are subject to availability and we reserve the right to substitute any prize with another prize of equivalent value without giving notice to the winners.
  • The promoter’s decision in respect of all matters to do with the prize draw will be final and no correspondence will be entered into.
  • The prize may not be claimed by a third party on behalf of the winners.

Selection of winners

  • The winners will be randomly selected from all valid purchases submitted in accordance with these terms and conditions and within the period of the competition.
  • When the winners are drawn, the names of the winners will be those individuals named on the order form.
  • The winners will be notified by phone and/or email within 28 days of the closing date.
  • If a winner cannot be contacted or does not claim the prize within the 28 days of notification, we reserve the right to withdraw the prize from that winner and pick a replacement winner.
  • The promoter will deliver the prize via post.

The Woodland Trust will collect and store the following data extracted from the order form:

  • Full name
  • Email address
  • Phone number
  • Address and postcode

This personal data will only be used for the following purposes:

  • communicating with winners regarding the delivery of their prize

  • marketing and publicity relating to the competition
  • where the applicant has expressly consented to receive such information, to provide information about the promoter’s work, activities, campaigns, goods, services or other promotions that the promoter offers.

By submitting an entry into this giveaway, applicants consent to their data, as detailed above, being processed by the Woodland Trust in accordance with, and for the purposes set out in, these terms and conditions.

General rules

  • No responsibility will be accepted for entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
  • Whilst every effort is made by the Woodland Trust to ensure that the prize offered is of the highest quality, no warranty expressed or implied is given as to the description, quality, growth, productiveness or suitability of the prize.
  • The Woodland Trust reserves the right to cancel or amend the tree giveaway at their discretion, and these terms and conditions, without notice in the event of a force majeure event including, but not limited to: catastrophe, governmental or local pandemic restrictions, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the tree giveaway will be notified to successful applicants as soon as possible by the Woodland Trust.
  • This competition and these terms and conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England. If any provision of these terms and conditions is held invalid by any law, rule, order or determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provision not held to be invalid.
  • These terms and conditions are valid as of 5 January 2024.
